¿Quién mató a Pedro?
La noche del 15 de diciembre de 1992 es asesinado en la ciudad catalana de L’Hospitalet de Llobregat un joven de 20 años, llamado Pedro Álvarez, de un tiro en la cabeza.
Pedro acompaña a su casa a su novia Yolanda, con quien sale desde hace 5 años. Justo después de despedirse, un coche que circula a gran velocidad por poco atropella a la joven, la cual en una reacción instintiva increpa al conductor. Éste sale del automóvil y comienza a discutir con la joven de forma violenta hasta el punto que la golpea y la tira al suelo. Pedro entonces vuelve corriendo para defenderla e inicia una discusión con el agresor, que se convierte en el asesino en el momento en que se dirige al coche (un Opel Vectra blanco), coge un arma y le dispara tres tiros al joven, uno de ellos mortal de necesidad, ante el intento de detenerle de una mujer que le acompañaba. Después vuelve al coche, con la misma sangre fría, y arranca mientras unas personas intentan socorrer a Pedro, que ingresa cadáver en el Hospital de Bellvitge, ante el estado de shock en que se encuentra Yolanda.

Las sospechas caen sobre un policía nacional (José Manuel S.F), y es detenido en seguida.Es igual a la descripción que se dio de él, las pruebas balísticas coinciden con las de las armas utilizadas por las fuerzas de seguridad del Estado y el agente es asiduo a la zona donde ocurren los hechos. Una persona conflictiva y con“cierto poder” en la misma. Además, es identificado inmediatamente por Yolanda, la única testigo del crimen.
El agente presenta una coartada tan pueril como concluyente para los encargados de la investigación: “Estaba en casa durmiendo después de haber acompañado a mi madre al hospital” y la investigación comienza volverse turbia. Se declara inmediatamente el secreto de las investigaciones, por lo que la representación de la familia no puede participar en ellas.A Yolanda se le somete a una sesión maratoniana de múltiples reconocimientos, calificada de irregular por juristas consultados. La joven al final manifiesta dudas sobre aspectos muy concretos del policía. Los familiares acusan en repetidas ocasiones que la titular del Juzgado de Instrucción numero 5 de L’Hospitalet, María José Magaldi, y el comisario Llorente no están llevando a cabo bien el procedimiento: la juez no ordena analizar las huellas del coche para identificar a la mujer que acompañaba al asesino, ni ordenó su identificación posterior, por ejemplo.
Finalmente, dos días después, se decreta la exculpación del agente por falta de pruebas fiables. Nadie ha seguido realizando hasta hoy ningún tipo de investigación posterior y no hay ninguna institución que haya apoyado al caso Pedro Álvarez, a pesar de que, por ejemplo, el ayuntamiento de L’Hospitalet se comprometió a ello, y los poderes públicos (políticos, fuerzas de seguridad, jueces y fiscales) están obligados legalmente a velar por el esclarecimiento de unos hechos tan graves como éstos. Los policías que iniciaron las investigaciones, por otro lado, tratan desde un principio criminalizar a Pedro, buscando antecedentes que no existían, para culparle de lo sucedido y así defender a su compañero.
El Síndic de Greuges y el Parlament de Catalunya(“defensor del pueblo”) respondieron, ante el ruego de la familia, que no tenía competencias al estar implicado un policía. Pasqual Maragall puso al concejal, sr.Ruiz, al frente del caso, el 10 de marzo prometió ayudar, aunque dijo no estar al corriente. Todavía no ha dado ninguna respuesta. Jordi Pujol respondió “Es una cosa dolorosa y lamentable, pero nuestras competencias son muy limitadas y poco podemos hacer”. El Congreso de los Diputados rechazó la pregunta sobre el caso por defecto de forma. El abuso de poder a que estamos sometidos queda, por desgracia para esta “democracia”, perfectamente claro.
